Welcome to FIXITHUB. These Terms of Service ("Terms") govern your access to and use of our website, IT support services, and related offerings (collectively, the "Services"). By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Services Overview
FIXITHUB provides professional IT support and technology services to businesses and individuals across South Africa. Our Services include, but are not limited to, cybersecurity solutions, Office 365 management, system monitoring, data backup and restoration, VoIP services, and SLA-based support agreements.
2. Account Registration & Eligibility
To access certain Services, you may need to create an account. You must be at least 18 years old and have the legal capacity to enter into a binding contract. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Service Agreements & Plans
Our Services are offered under monthly subscription plans or project-based contracts as detailed on our Pricing page. By subscribing to a plan or accepting a quote, you agree to the specific terms, scope, and pricing outlined in your Service Agreement or quote acceptance. Service level agreements (SLAs) apply only to plans explicitly labeled as including SLA coverage.
4. Payment & Billing
Subscription fees are billed monthly in advance and are payable within 7 days of invoice date. Project-based services require a 50% deposit before work commences, with the balance due upon completion. Late payments may result in service suspension. All fees are quoted in South African Rand (ZAR) and exclude VAT unless otherwise stated. We reserve the right to adjust pricing with 30 days written notice.
5. Client Responsibilities
You agree to provide our technicians with reasonable access to your systems, network, and premises as required to deliver Services. You are responsible for backing up critical data before we perform any maintenance, migration, or repair work. You must ensure that all software licenses are valid and that you have the legal right for us to access and modify your systems.
6. Intellectual Property
All intellectual property rights in our website, software, tools, methodologies, and documentation remain the property of FIXITHUB. You are granted a limited, non-exclusive, non-transferable license to use our deliverables solely for your internal business purposes. You may not reverse-engineer, copy, or redistribute our proprietary materials.
7. Limitation of Liability
FIXITHUB will not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our Services, including but not limited to data loss, business interruption, or lost profits. Our total liability for any claim arising from our Services shall not exceed the total amount paid by you to FIXITHUB in the 12 months preceding the claim.
8. Confidentiality
Both parties agree to keep confidential all proprietary information disclosed during the provision of Services. FIXITHUB implements industry-standard security measures to protect your data but cannot guarantee absolute security. We will notify you promptly of any known data breach affecting your systems.
9. Termination
Either party may terminate a subscription plan with 30 days written notice. Project-based contracts may be terminated by either party with 14 days notice, with fees payable for work completed up to the termination date. Upon termination, we will cooperate with you to transition your systems and data to an alternative provider if requested.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, disputes will be submitted to arbitration in Johannesburg under the rules of the Arbitration Foundation of Southern Africa.
11. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our Services after changes constitutes acceptance of the updated Terms.
